School board discusses preliminary allegations

The Willow River school board met in a special closed session on Monday to discuss "preliminary consideration of allegations against an employee subject to its authority," namely, Superintendent Scott Anderson. Also attending the meeting were John P. Edison, attorney from Rupp, Anderson, Squires & Waldspurger, and Jenny Johnson, district administrative assistant. The closed session lasted nearly three hours, including a recess.

The board reopened the meeting at 8:10 p.m. A motion was approved to proceed as discussed in the closed meeting. In addition, the board directed that letterhead be sent to Edison for correspondence and discussed meeting with staff on Wednesday morning.

According to Minnesota

Statute 13d.05, "A public body shall close one or more meetings for preliminary consideration of allegations or charges against an individual subject to its authority. If the members conclude that discipline of any nature may be warranted as a result of those specific charges or allegations, further meetings or hearings relating to those specific charges or allegations held after that conclusion is reached must be open. A meeting must also be open at the request of the individual who is the subject of the meeting."

Therefore, future meetings by the school board on this matter should be open if the status of the complaint as a result of the closed meeting\ Monday shall include discipline of any kind for Anderson, noted Minnesota Newspaper Association attorney Mark Anfinson in a phone call Tuesday.
