Lawyers strike jury Monday, talk $10 million

Greg Allen had asked if any potential jurors would have problems with a $10 million judgement Monday morning, Aug. 31.

Allen, from Montgomery, is representing Anita Robinson in a lawsuit against Nissan in Japan, Nissan in America, and Nissan distributors.

Monday afternoon, opposing counsel asked the same question and two white females stood and said they would have problems with that.

Also on the legal team with Allen is John Gibbs of this county and Kendall Dunson of Montgomery.

Representing Nissan are Stanley A. Cash and Alan Thomas of Birmingham associated with Woodie Dinning of Demopolis.

After the jury was struck Monday afternoon, both sides were before Judge Eddie Hardaway working out details of the opening arguments and the two-week trial.

The complaint, which clerks said there was not one in the Marengo County circuit clerk's office, lists the three Nissan entities.

Another suit against GMAC Insurance and A. G. Jowers was dismissed.

The statement which was the crux of that suit states that GMAC Insurance issued to Anita Robinson policies containing uninsured motorists coverage.

It contends that the policy of A. G. Jowers was insufficient to cover the injuries of the plaintiffs so it was an under-insured vehicle.

It accuses the defendant willfully and wantonly and with reckless disregard caused Anita Robinson to lose control of her vehicle.

It stated the Jowers was meeting the Robinson vehicle on Highway 10 and the Jowers car turned left in front of hers and this caused Robinson to lose control and wreck, causing the injuries to the plaintiff.

The complaint states the insurance policy was in effect on July 11, 2007, when the accident occurred.

The plaintiff was rolled into the courthouse on a hospital wheel chair and was parked in front of the courtroom as jury selection was taking place.

The plaintiff lawyers are from the Montgomery firm of Beasley, Allen, Crow, Methvin, Portis, & Miles, P. C.

The defense lawyers are from the Birmingham firm of Huie, Fernambucq & Stewart.

After the twelve and alternates were struck, Judge Hardaway adjourned proceedings until Tuesday morning.
