Port denies Miles request for reimbursement

After a month of legal review, the Port of Shelton Commission voted to not reimburse commissioner Jack Miles for legal expenses he incurred when he made a harassment complaint against port director John Dobson in January.

Port attorney Charles "Skip" Houser compiled a brief on Miles' request for compensation.

"Have you changed your opinion about your reimbursement after reading this?" commissioner Tom Wallitner asked Miles.

Miles responded, saying that no statute specifically precludes the commission reimbursing him, then he should be reimbursed.

Commissioners Jay Hupp and Wallitner disagreed with Miles' interpretation.

"It is my opinion that this commission can only authorize legal fees if you incur, or defend yourself from a lawsuit, you must be the defendant, not the plaintiff," Wallitner said.
