Ex-con given five-year sentence

An ex-convict who spent two years behind bars for a 1996 drive-by shooting has been given a five-year prison term for firing 11 bullets from, a car into a Stillwater house seven months ago -- while two people were inside sleeping

Daniel Levi Studie, 33, of Stillwater, was also given a concurrent five-year prison term Friday for using a baseball bat to rob another man at the same residence two hours before the shooting.

When he pleaded guilty Friday to using a vehicle to facilitate the discharge of a weapon and robbery with a weapon, Studie said that he understood he would be required to be incarcerated for at least 85 percent of his five-year sentence before he could be released.

Studie must register under the Mary Rippy Violent Crimes Registration Act when he gets out of prison, Associate District Judge Stephen Kistler told him Friday.

Stillwater Police Detective Les Little wrote in an affidavit that at about 3: 20 a.m. on Feb. 5 of this year, Studie entered a house in the 800 block of S. Monroe Street and assaulted Josh Hunt with a baseball bat and stole his cell phone, guitars, amplifier and wallet.

Hunt's roommate, Christopher Sindone, awoke and saw Studie in his residence with a baseball bat and having a black semi-automatic handgun in his waistband, the affidavit said.

"Before leaving the residence, Daniel Studie threatened to kill Josh Hunt if the police were notified," the affidavit alleged.

"Josh Hunt was taken to the Stillwater Medical Center to be treated for the injuries he received from the assault.

"Daniel Studie contacted Josh Hunt by phone and asked him for the PIN number to unlock the cell phone just stolen," the affidavit said.

"Josh Hunt refused to give the PIN number to Daniel Studie," the affidavit said.

About two hours later, someone drove by the same house and shot the residence 11 times -- while Hunt was still at the hospital being treated, the affidavit said.

Sindone and his girlfriend were sleeping inside the house and awoke when they heard bullets striking the residence, the affidavit said.

Stillwater police found 9 mm shell casings in the street in the front of the house, the affidavit said.

A short time later, Stillwater Police Officer Greg Calloway located Studie, who was leaving an apartment on S. Wick-low Street, the affidavit said.

Studie was arrested at about 7 a.m. for the assault on Hunt, the affidavit said.

When a search warrant was served at Studie's apartment, police recovered Hunt's guitars, amplifier and wallet --as well as unfired 9 mm ammunition, the affidavit said.

In 1997, Studie was convicted of another drive-by shooting in Payne County and possession of a drug with intent to distribute, for which he was given two concurrent five-year prison terms followed by five years of probation. He was released from prison in 1999, state Department of Corrections records show.
