NOTICE OF SHERIFF'S SALE

By virtue of a Writ of Execution issued out of the Circuit Court for the State of Oregon for the County of Gilliam, on August 19, 2009, pursuant to the Judgment entered in the register of said county July 30, 2009 in favor of Plaintiff Old West Federal Credit Union, and against the Defendants Thomas C. Mashos, Sheryl M. Mashos, Celeste Johnson, and United States of America, Case No. 09-0004CC, together with written instructions, to me directed, commanding me to sell all the right, title, interest and claim of the above plaintiffs in and to certain real property in the sum of $112,785.82; plus unpaid interest of $9,637.30; plus interest accruing at the rate of $25.9562 per day on the unpaid principal balance of $112,785.82, from February 5, 2009, until paid, plus an additional penalty of $48.40 as reasonable expenses; the further sum of $1,875.00 as Plaintiff's reasonable attorney fees and $566.72 as Plaintiff's reasonable costs; plus the costs of the sale. On August 31, 2009, I levied on the defendants right, title, interest and claim in and to the following real property:

GILLIAM COUNTY, OREGON

Township 1 South. Range 21 East. W.M.:

Section 10: A tract described as follows:

Beginning at the Northeast corner of the Northwest quarter of the Northeast quarter (NW1/4 NE1/4), thence West along the North line of said section to the Northwest corner of the Northeast quarter, thence South along the half-section line to the Southwest corner of the Northwest quarter of the Northeast quarter (NW1/4 NE1/4), thence East 150 feet, thence South 32° 25' East 1,000 feet, thence North 5° 00' West 1,195.0 feet, thence North 68° 45' East 800.0 feet to the intersection of the East line of the Northwest quarter of the Northeast quarter (NW1/4 NE1/4) of said section, thence North along said East line 685 feet to the place of beginning.

EXCEPTING THEREFROM THE FOLLOWING TRACTS:

1. Approximately five acres conveyed to J.A. Crum by deed, recorded in Volume A of Deeds, page 31, as follows:

Beginning at a point 198 feet East of the Northeast corner of the Northwest quarter of Section 10, running thence West 198 feet, thence South 792 feet, thence East 330 feet, thence in a Northerly direction to the place of beginning.

2. A tract conveyed to Allen E. Campbell and Bessie M. Campbell, husband and wife, to Pacific Power and Light Company, recorded in Deed Book 29, page 569, records of Gilliam County, Oregon, TO WIT:

Beginning at a point 792 feet South and 290 feet East of the Northwest corner of the Northeast quarter of Section 10, Township 1 South, Range 21 East, W.M.; thence South and parallel to the West line of said Northeast quarter of Section 10, 100 feet; thence East to Rock Creek; thence Northerly down said Rock Creek to a point East of point of beginning; thence West to point of beginning; together with the right of ingress and egress from the public road to said property.

3. Tracts conveyed by deed, including the terms and provisions thereof, to the State of Oregon, by and through its Department of Transportation, recorded August 24, 2004, in Gilliam County Deed Records as M-74-51.

ALSO EXCEPTING State Highway right of way.

Notice is hereby given that I will on the 1st day of October, 2009 at 10:00 o=clock a.m., at the front doors of the Gilliam County Courthouse in Condon, Oregon, sell at public auction, subject to redemption as provided by law, to the highest bidder for cash or cashier's check in hand, all the interest that the above named Defendants had on February 2, 2007, the date of the contract sale, and all the interest that Defendants had thereafter, in the above described real property.

Before bidding at the sale, a prospective bidder should independently investigate:

a. The priority of the lien or interest of the judgment creditor;

b. Land use laws and regulations applicable to the property;

c. Approved uses for the property;

d. Limits on farming or forest practices on the property;

e. Rights of neighboring property owners; and

f. Environmental laws and regulations that affect the property.

The judgment creditor may bid any portion or all of its judgment and costs allowed by ORS 18.950(2) and ORS 18.999.
