Court issues $6.4 million judgment against local family, businesses

A default on a forbearance agreement dated Aug. 1, 2006 has resulted in a $6,414,960.70 judgment against a number of area corporations and individuals.

The Alma Creamery L.L.C., DW Enterprises L.C. (which has been developing the Park Valley Subdivision, Alma), Flint Hills Foods L.L.C., Concept Solutions Inc. f/k/a/Concept Foods Inc. and Flint Hills Foods, Todd Hansen, Donelyn Hansen and Bernard Hansen all are named as defendants in the judgment.

The journal entry of judgment, which was filed in Wabaunsee County Sept. 9, 2009, says a forbearance agreement was defaulted on, which entitles the plaintiff, Intrust Bank, N.A. to obtain a judgment against each of the parties listed.

The judgments were issued jointly and separately, meaning each individual or corporation listed could be liable for the maximum amount listed against them in the judgment, or the payment could come from all of the different entities involved to total the approximately $6.4 million.

The judgment against Alma Creamery totals a principal amount of $500,000 and the judgment against Todd Hansen totals a principal amount of $100,000.

Each other entity received a principal amount of $6,414,960.70,

Both pre- and post-judgment interest also may be collected at a variable rate, as well as a cost of $168 and attorney fees for $2,500 and any other cost occurred by Intrust Bank as it collects or attempts to collect the judgment.
